Florida Public Health Pest Control sample

1. In Florida, you apply a pesticide to control mosquitoes on a neighbor's property. You are not working under a licensed applicator. The product is general use. What does the public health rule require?

   • Nothing further. General-use products sit outside the public health license.
   • A public health pest control license, even though the product is general use.
   • A chapter 482 structural operator certificate, because the work is pest control.
   • A private applicator license, because the treatment is outdoors on land.

On someone else's property, that license is required even when the product is general use.

General use is not an exemption in this rule.

Chapter 482 is structural pest control, not this mosquito rule.

The exception is your own residence or farm, not a neighbor's land.

2. Florida's public health rule sets a score for the public health exam and for the general standards core exam. What does an applicant have to do?

   • Score 70 percent on the public health exam. Core is optional for agency staff.
   • Score 80 percent on each exam before the department will issue the license.
   • Score 70 percent on the public health exam and 70 percent on the core exam.
   • Average 70 percent across the two exams, so a high score can carry a low one.

The rule requires 70 percent on the public health exam and 70 percent on the core exam.

Core is required too. It is not optional.

The rule states 70 percent, not 80.

Each exam has its own 70 percent score. An average does not replace that.

3. Your Florida public health pest control license runs for four years. What continued-competency evidence does the rule require before renewal?

   • At least 16 public health continuing education units during those four years.
   • Four core units in the final year, and none required in the earlier years.
   • A core exam retake every year, instead of any continuing education.
   • Sixteen units only if you applied restricted-use products during the term.

You need at least 16 public health continuing education units during the four-year license.

The rule does not substitute four units in a single year.

Yearly core retakes are not the renewal path in this rule.

The units are for the license, not only for restricted-use work.

4. How long must a Florida public health applicator keep the pesticide-use reports described in the mosquito-control rule?

   • One year from the application date, then the reports may be discarded.
   • Until the next renewal, and then the reports may be discarded.
   • Two years, the same period used for a federal supervision record.
   • Three years, and provide them if the department asks.

Keep those pesticide-use reports for three years, and provide them if the department asks.

The period is three years, not one.

Renewal does not end the retention period.

Two years is a different record rule. These reports are kept for three.

5. A concentrate is Toxicity Category I as sold. The use directions dilute it, and the spray mix would fall in a lower category. Which signal-word rule applies?

   • Use the signal word for the diluted mix, because that is what you apply.
   • Drop the signal word. Dilution removes the Category I hazard from the label.
   • Print Caution on the front panel and Danger on the back panel.
   • Keep Danger for the product as sold, and use one signal word on the label.

The signal word follows the product as sold, and the label uses only one signal word.

A dilution note may be added. It does not change the signal word.

Dilution does not remove the signal word of the product as sold.

Different signal words on different panels are not allowed.

   40 CFR 156.64(a) and (b)

6. A product is Toxicity Category IV by every route of exposure, so no signal word is required. What must the front panel still show?

   • No child-hazard line. Category IV products are exempt from that statement.
   • Keep out of reach of children, on its own line, near the signal-word spot.
   • The child warning only when the container is small enough for a child to carry.
   • The word Poison in red, plus the skull and crossbones symbol.

Category IV products still need that child warning on the front panel, on its own line.

The warning is required even when no signal word is required.

Container size is not the test in this section.

Poison and the skull symbol belong to Category I toxicity, not Category IV.

7. Federal rules list commercial applicator categories. Who falls under public health pest control in that list?

   • Government employees and contractors in government public health programs.
   • Any resident treating mosquitoes in their own yard, with any product.
   • Only pilots. The category is limited to aerial application.
   • People treating seed inside a commercial seed-treatment facility.

That federal category covers government employees and contractors in government public health programs.

A resident treating their own yard is not who this category describes.

Aerial work is a separate category. Public health is not limited to pilots.

Seed treatment is its own category, not public health.
